Cyber Law

Cyber law in Malaysia is a growing and dynamic field, reflecting the increasing importance of digital technology and the internet in all aspects of life. As digital transactions, e-commerce, and online interactions grow, there will be a greater need for regulatory frameworks to address cybercrimes, data protection, and digital rights. Rapid advancements in technology, such as artificial intelligence, blockchain, and the Internet of Things (IoT), will require corresponding legal developments to address new challenges and opportunities. In Malaysia, cybercrime refers to illegal activities conducted via the internet or involving computer systems. Some common examples of cybercrime in Malaysia include but not limited to Online Fraud, Hacking, Identity Theft, Ransomware Attacks, Cyberbullying and Harassment. These crimes are addressed under various laws in Malaysia, such as the Computer Crimes Act 1997, Penal Code, and Communications and Multimedia Act 1998.

In this developing era, 'DATA IS AN ASSET '. Personal, financial, and business data are often targeted by cybercriminals. Cybersecurity measures help safeguard against data breaches, which can result in identity theft, financial loss, and reputational damage. Customers, clients, and partners expect their data to be handled securely. A strong cybersecurity framework helps maintain trust, which is essential for business relationships and consumer confidence. Many countries, including Malaysia, have regulations that require organizations to implement proper cybersecurity measures. Non-compliance can lead to legal penalties and fines. In this interconnected and digital world, cybersecurity is essential for the smooth functioning of economies, the safety of individuals, and the protection of privacy and security at all levels.

We at Komathi Arunasalam, strive in our efforts to raise public awareness about cyber security, data protection, and legal rights and responsibilities in the digital sphere where it has become increasingly important in helping organizations navigate legal complexities related to data privacy and cybersecurity. From the threat of hacking and breach of personal data, we have dealt with our client's concerns including and not limited to dealing with the respective government agencies such as Department of Personal Data Protection (PDP) and Malaysian Communication and Multimedia Commission (MCMC).

The gravity  of cyber crimes has led to the introduction of Cyber Security Act 2024 and we are one of the pioneer legal firms exploring and applying the development to our clients who has been affected by these crimes.

Probate and Administration

Estate administration is the process of determining the rights and legal transfer of ownership of all possessions and assets, upon the occasion of an individual’s death. Such administration usually follows the wishes of an individual’s Will, but can become more complicated if such a record of the wishes does not exist.

If a valid Will exists, executors will be appointed per the Will’s terms, who must distribute the estate. The executors need to apply to the High Courts in Malaysia for a Grant of Probate, which allows the estate and its assets to be ‘released’ so that executors can do things like pay off debts, transfer or sell property, and ensure the beneficiaries get what they are entitled to. In these circumstances, no distribution order, sureties or guarantors are needed. However, if a valid Will does not exist, application for Letter of Administration must be made in the High Court. Upon receipt of Letter of Administration of the deceased’s estates, the Administrator is required to register the Letter of Administration at the relevant Land Office so that all registration of the assets of the deceased is registered in the name of the Administrator. The Administrator then has to file an application for the distribution of deceased’s estate at the same Court.

Applications for both the Grant of Probate and the Letters of Administration may turn out to be complex along the process, especially if contested. We at Komathi Arunasalam work closely with our clients to expediate the process, prepare the necessary documentation, make applications and represent in your interest if a dispute arises in any circumstances.

Conveyancing Matters

Property transfer in Malaysia involves a structured legal process to ensure the proper transfer of ownership from the seller to the buyer.

The property transfer process in Malaysia is detailed and requires careful attention to legal and administrative procedures. Engaging experienced legal professionals can help ensure a smooth and compliant transaction. Due diligence is the fundamental element in conveyancing and it is our priority in ensuring our clients rights are protected.

Drafting Agreements

In Malaysia, several types of agreements often require the assistance of a lawyer to ensure they are legally sound, compliant with relevant laws, and protect the interests of the parties involved.

Involving a lawyer in drafting, reviewing, and finalizing these agreements helps ensure they are legally enforceable and tailored to the specific needs and circumstances of the parties involved. We at Komathi Arunasalam will work closely with companies, commercial agreements, as well as individual agreements such as tenancy and property agreements to make sure they avoid risks and problems that might arise.
